Understanding Negligence and Liability

Most personal injury cases are based on negligence: a failure to act with reasonable care when it was their responsibility. 

There are four elements of negligence, all of which must be established for a valid personal injury case.

  1. Duty of Care: This means that one party has a responsibility to act with a reasonable level of care to another person. For instance, every driver has an obligation to protect others on the road by driving safely and following traffic laws.
  2. Breach of Duty: This means that one party failed in their duty. By choosing to text and drive, for example, a driver is breaching their duty to keep others safe.  
  3. Causation: Causation establishes that you were injured because of the breach of duty, aka the actions of the other party. AND, that your injuries were the result of the breach of duty. This is meant to rule out injuries that a person may have already had before the incident.
  4. Damages: The other party’s negligence must have caused losses. Losses include medical bills, pain, missed time from work, or anything else that caused you damage or loss.

After you’re involved in a personal injury accident, it’s important to take certain steps in order to help keep you safe and help your potential case. 

Get out of harm’s way and call 911 if necessary.

Get information from any involved parties, such as contact and insurance information.
